TERMS OF SERVICE

From herein, the entity “Dakkii” will be referred to as “The Artist” or “Artist” and the client entity will referred to as “The Commissioner” or “Commissioner.”
All produced works will include the Artist’s signature or logo and links to their website, E-mail, and Patreon page. The Commissioner is not allowed to remove any of these elements. The signature enables the Artist’s produced work to be identifiable for promotion. It prevents it from being illegally distributed in any way, shape, or form by anyone - including the Commissioner without proper credit.
FOR MAIN COMMISSIONS
The Commissioner can send their commission application by submitting one through the provided Google Form. The Artist will review each request and choose the ones they wish to accept. The Artist retains the right to ignore or decline any Commission Request sent or discussed before payment. After payment, the Artist can still refuse, but the Commissioner will be refunded an amount dependent on the situation (see VII. CUSTOMER SATISFACTION for more information).
When all Commission Slots for the Commission Period are full, Commissions will immediately close, and the Artist will discard all other rejected or ignored requests. There may be times when Commissions are open indefinitely and slots will not matter.
If the request is accepted, the Artist will initiate communication with the Commissioner through Discord, Twitter, or Bluesky. The Commissioner must have an account on one of these platforms to continue their request.
The Commissioner must provide adequate references for the work they would like produced. A minimum of two (2) of these pieces is required, but supplying more than one reference is encouraged.
The Commissioner may send additional images after acceptance of their request.
FOR SKETCH STREAM COMMISSIONS
During a “Sketch Commission Stream,” the Artist will grant an allotted timeframe of 10 minutes for viewers to complete the appropriate form linked in the description of the stream.
Next, once that time has elapsed, the Artist will pick all the requests they want to work on.
Then, after all the requests have been handpicked, the Artist will put all of the requests into a raffle and pull out four of them at random. The four that get picked will be drawn live on stream. Requests that didn’t get picked will be deleted.
Deleted requests can still be made at the next sketch commission period, however like all requests made, they must adhere to the Artists Do’s and Don’ts. If a request does not fall within those rules it will immediately be deleted.
Using Finished Works for training AI models and image generation is STRICTLY PROHIBITED. Necessary legal action and compensation will be pursued should an infraction be found.

Payments are accepted in USD and made through PayPal or Ko-Fi. Other Payment methods can be discussed.
FOR MAIN COMMISSIONS:
The Commissioner will pay either in full or in part after they accept the first WIP images will be heavily watermarked and in lower resolution. The Commissioner will only receive the unwatermarked, full resolution image after full payment has been made.
The Artist will send all PayPal invoices to the Commissioner’s E-Mail address. The Commissioner must ensure that the E-Mail they provide is one they use and check often.
The listed prices are also subject to change over time. Opportunities for discounts are also possible at the Artist’s will. Payments may be adjusted to include transfer fees.
FOR SKETCH STREAM COMMISSIONS
If the Commissioner’s request is chosen in the raffle, they will have to pay upfront before the Artist will start work on their Commission.

FOR MAIN COMMISSIONS
The Artist will notify the Commissioner upon starting work on the Commission Order. The Artist can send work-in-progress images on request by the Commissioner to ensure the Finished Work is accurate and meets the Commissioner’s standards. The Artist will heavily watermark these images to prevent theft.
Posting Work-In-Progress Images is strictly prohibited and can result in a cancellation of the request and a denial of a refund or fee.
Commissions are completed on average two (2) weeks to 1 month after acceptance by the Artist. Factors such as work/school/family affairs, health, and the complexity of the piece commissioned may extend the delivery date.
Should anything arise that will slow down or stop the process of the order’s estimated delivery time, the Artist will inform the Commissioner as soon as possible.
Upon completion of the piece, the Commissioner will receive the full image of the Finished Work via E-Mail or their secondary messaging as a .PNG or .JPG file. If the Commissioner would like the Finished Work in other/additional file types, they may note it while filling out the request form or ask the Artist during production. There is no physical product.
The Artist will post the Finished Work onto their social media platforms with the social media tag or username of the Commissioner.
If they so wish, the Commissioner may request for their username to be omitted from the public post for no charge, OR for their finished work to remain private and not be publicly posted for a $20 Privacy fee.
The Finished Work may also appear in promotions for future Commission Periods. The Commissioner can post their Finished Work to whatever platforms they please.
FOR SKETCH STREAM COMMISSIONS
The Artist will work on the Commissioner’s request over the course of the stream. If a stream ends and all requests have not been completed, then another stream will be held to continue from where The Artist had previously left off until all the requests for that period have been completed.
A new raffle will not be held until all the requests are completed.
The Artist will send the finished work to the Commissioner via the options given in the Sketch Commission form.

FOR MAIN COMMISSIONS
If the Commissioner requests an alteration to the Finished Work after accepting it, they must pay a Revision Fee. The amount charged will be proportional to the complexity of the change the Commissioner wants the Artist to make and how much time it may take to implement.
The Commissioner will receive WIP sketches that must be accepted before the Artist can continue. The fee will increase if the Commissioner makes more alteration requests after the first. The Artist has the right to deny any Revision Request.
Unclear instructions or references sent at the beginning of the agreement or asking for Revisions after confirming the “Artist’s Choice” option will result in a greater charge. It is the Commissioner’s responsibility to ensure that the Artist clearly understands what they want drawn to minimize confusion and miscommunication.
FOR SKETCH STREAM COMMISSIONS
If the Commissioner is able to tune into the stream, they are able to ask for simple revisions. The Artist may check in with the Commissioner live in the chat to corroborate mistakes and changes they would like to be made.
It is heavily recommended that the Commissioner stay for the majority of the stream while their request is being worked on. Once the request is complete, no more revisions are allowed.

FOR MAIN COMMISSIONS
The Artist, not the Commissioner, claims the copyright to the Finished Work. Therefore, the Artist is allowed to use the Finished Work to:
Publish books, cards, posters, and other physical media.
Display the Finished Work wherever the Artist may like.
Post or Upload the Finished Work wherever the Artist may like.
Use the Finished Work to promote themselves or their services anywhere and everywhere.
However, the Commissioner is allowed to:
Use the Finished Work for personal use, and claim the character(s) as their creation(s), not the art itself.
Use the Finished Work to promote themselves. Credit is required.
The following is considered copyright infringement:
Altering the Finished Work without the Artist’s consent.
Removing the Artist’s signature or information from the Finished Work.
Claiming the Finished Work as if you (the Commissioner) had created it.
Reproducing or profiting off of the Finished Work commercially.
The Artist offers a one-time Royalty fee of 50% of the original price of the Finished Work, and depending on what the Artist is required to create, this fee may increase; however, the Commissioner can negotiate a lower percentage if the Artist is willing.
FOR SKETCH STREAM COMMISSIONS
All rights are reserved to the Artist, however the Commissioner can upload their finished work to any platform and use it non-commercially.
If the finished work is uploaded, the Commissioner must give credit to the Artist in the same post.

FOR MAIN COMMISSIONS
Refunds are accepted and will be paid back in full upon request or in the event that the Artist cannot deliver the finished work.
However, after the first WIP has been accepted, the refund amount will be lowered.
The refund will be given directly back to the Commissioner through PayPal. No chargeback is required.
Refunds are voided after the finished work is completed.
FOR SKETCH STREAM COMMISSIONS
Sketch Stream Commissions are non-refundable once they have been paid for. However if a Commissioner wants to cancel their request AFTER they have paid but BEFORE the Artist begins work on it, they are able to do so and will receive 100% of their money back.
If the finished work is completed, the Commissioner will not be eligible for a refund.
